1. Acceptance of Terms

By using the CoinsSend service ("CoinsSend" or the "Service"), you acknowledge that you have read, understood, and agree to these Terms of Use ("Terms"). These Terms form a binding agreement between you (the "User") and the operators of CoinsSend. If you do not agree with any part of the Terms, you must immediately discontinue use of the Service. We reserve the right to modify or update these Terms at any time. Updated Terms will be effective upon posting on our website, and your continued use of the Service after any changes constitutes acceptance of the revised Terms. 2. Description of the Service

CoinsSend is an online crypto-processing platform that enables users to accept cryptocurrency payments, perform payouts, and store supported cryptocurrencies. The Service supports only digital assets (such as USDT and USDC on Tron, Ethereum (ETH), and BSC, among others) and does not involve any fiat currency or traditional banking services. CoinsSend provides a technical interface for transferring and holding crypto assets; it is not a bank, money transmitter, or investment advisor. The Service is provided on an "as is" and "as available" basis without any warranty of uninterrupted availability or accuracy. While we strive to ensure the reliability and security of the platform, crypto transactions inherently carry risks (e.g. market volatility, network issues, hacking, force majeure) that we cannot completely foresee or prevent. You acknowledge that CoinsSend may integrate third-party blockchain services or APIs to fulfill transactions. We do not guarantee the suitability or performance of any third-party services and assume no liability for their acts or omissions.

3. Eligibility and User Responsibilities

3.1 Legal Capacity: You must be at least 18 years old (or the age of majority in your jurisdiction) and legally capable of entering into agreements to use CoinsSend. You are solely responsible for ensuring that your use of cryptocurrency and the Service is legal in your jurisdiction. By using CoinsSend, you represent that you are not prohibited by any law or sanction from accessing cryptocurrency services. If you are using the Service on behalf of a company or other legal entity, you represent that such entity is legally organized and that you are authorized to accept these Terms on its behalf. The entity will be held responsible if you violate these Terms while acting on its behalf.

3.2 Account Security: In order to use certain features of the Service (for example, to manage payouts or stored funds), you may need to create an account. When creating an account, you agree to provide truthful and up-to-date information if requested. No Know-Your-Customer (KYC) verification is required under normal circumstances to create or use an account on CoinsSend. You are responsible for maintaining the confidentiality of any authentication credentials (such as passwords or API keys) and for restricting access to your account. Any actions taken through your account are your responsibility. You agree to notify us immediately if you suspect any unauthorized access to or use of your account or security breach. When using CoinsSend, you agree that you will NOT engage in any of the following activities:

* Illegal Activity: Use the Service to support, pay for, or engage in any unlawful activities, including but not limited to illegal gambling operations, fraud, money laundering, terrorist financing, or any other criminal or illicit conduct. CoinsSend has zero tolerance for using its platform in connection with illicit activities of any kind.
* Violations of Law: Violate any applicable laws or regulations through your use of the Service. You must comply with all sanctions, export control laws, and any financial regulations that apply to cryptocurrency transactions in your jurisdiction.
* Interference and Unauthorized Access: Use any robot, scraper, crawler, or other automated means not provided by CoinsSend to access the Service or extract data. You also agree not to attempt to gain unauthorized access to other users’ accounts, wallets, or data, and not to bypass or breach any security or authentication measures of the Service.
* False Information: Provide false, inaccurate, or misleading information to CoinsSend or other users of the Service. This includes impersonating any person or entity, or falsely stating or misrepresenting your affiliation with a person or entity.
* Abuse of Service: Encourage or induce any third party to engage in any of the activities prohibited under this section. You will not use the Service in a manner that could disable, overburden, or impair the functioning of CoinsSend (e.g., through sending spam, introducing malware, or performing denial-of-service attacks).
* Unauthorized Integrations: Develop or use any third-party applications or interfaces that interact with the CoinsSend Service without our prior written consent. Similarly, you may not frame or mirror the Site, or otherwise make it appear that a third-party site is associated with CoinsSend.

CoinsSend reserves the right to investigate and take appropriate action (including suspension or termination of accounts and legal action) against any user who, in our judgment, violates these Prohibited Uses or any other provision of these Terms. You understand that if your use of the Service is flagged for possible illegal or prohibited activity, CoinsSend may freeze any associated funds and/or provide information to appropriate authorities as described in our AML Policy.

5. Privacy

6. Security of the Service

CoinsSend employs reasonable security measures to protect users’ funds and information. However, you understand that no system is perfectly secure or immune to risks. The nature of cryptocurrency and the Internet means that there is potential for cybersecurity threats, hacking, malware, blockchain network congestion or failures, and other technical difficulties beyond our control. You use CoinsSend at your own risk. We urge you to take appropriate precautions, such as using strong passwords, enabling any security features we may offer (e.g., two-factor authentication), and keeping your private keys or recovery phrases (if applicable) safe. CoinsSend will never ask for your private keys; any request for such information claiming to be from us is fraudulent. If you become aware of any unauthorized access or security breach related to the Service, you should notify us immediately. While we work diligently to secure the Service, you acknowledge that CoinsSend shall not be held responsible for breaches or losses caused by circumstances beyond our direct control (including but not limited to cyberattacks or failures of third-party providers).

7. Disclaimers of Warranties

CoinsSend provides the Service "as is" and without any warranty or guarantee. To the fullest extent permitted by law, we and our team disclaim all warranties, whether express, implied, or statutory, regarding the Service. This includes, but is not limited to, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee that the Service will be error-free, uninterrupted, or free of viruses or other harmful components. No information or advice (written or oral) obtained by you from CoinsSend or through the Service shall create any warranty not expressly stated in these Terms. You acknowledge that cryptocurrency transactions are irreversible by nature; CoinsSend cannot undo or refund transactions once executed on the blockchain except as explicitly provided by our policies. CoinsSend and its developers or operators make no warranty that (a) the Service will meet your requirements or expectations, (b) the results obtained from the Service will be accurate or reliable, or (c) any issues or defects in the Service will be corrected. We strive for a high standard of service, but unforeseen events (such as network outages, extreme market conditions, regulatory changes, or force majeure events) may occur and are beyond our control.

8. Limitation of Liability

Under no circumstances will CoinsSend or its contributors be liable for any indirect, incidental, special, consequential, or exemplary damages arising from or relating to your use of (or inability to use) the Service, even if we have been advised of the possibility of such damages. This includes, without limitation, damages for lost profits, lost data, loss of goodwill, business interruption, or other intangible losses. In no event shall CoinsSend’s total cumulative liability to you for any claims arising out of or relating to these Terms or the Service exceed the total fees (if any) you paid to CoinsSend for the use of the Service in the three (3) months immediately preceding the event giving rise to liability. 9. Indemnification

You agree to indemnify and hold harmless CoinsSend and its owners, developers, affiliates, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to your use of the Service, your violation of these Terms, or your infringement of any rights of any other person or entity. This indemnification obligation includes, but is not limited to: (a) your breach of any provision of these Terms or any applicable law, (b) any content or data transmitted through your account (e.g. the nature of any transactions you process via CoinsSend), and (c) any dispute or issue between you and any third party (such as a customer or recipient of a payment) relating to your use of CoinsSend. 10. Suspension and Termination of Service

10.1 Suspension/Termination by CoinsSend: We reserve the right, in our sole discretion, to suspend, terminate, or refuse service to you at any time with or without prior notice if we suspect that: (a) you have violated these Terms or any applicable law; (b) your use of the Service is malicious, fraudulent, or poses security or legal risks; or (c) you have provided false information or refused to provide information that we may require for compliance purposes. We may also suspend or terminate the Service (in whole or in part) or your specific access to it for any reason or no reason, including discontinuation of the Service or technical/security issues that arise, without liability to you. In the event of discontinuance or termination, any crypto assets of yours that we custodially hold (for example, funds stored in your CoinsSend account wallet) and that are not subject to dispute or owed to us will, at our discretion, be returned to you, unless we believe you have engaged in fraud, money laundering, or other misconduct. If we terminate your access due to suspected prohibited or illegal activities, you understand that we may be unable to release funds or may be required to freeze funds pending investigation or as directed by law enforcement. CoinsSend shall not be liable for any losses you may incur due to our good faith suspension or termination of your access.

10.2 Your Termination: You are free to stop using CoinsSend at any time. If you have an account, you may terminate it by ceasing all use and (if applicable) requesting account closure through any available interface or contacting our support. Any pending transactions before termination may be canceled by us if not completed, and any remaining funds in a custodial wallet can be withdrawn by you (provided such funds are not subject to holds as described above). Sections of these Terms that by their nature should survive termination (such as liabilities, indemnities, and dispute resolution provisions) will continue to apply.

10.3 Effect of Termination: Upon termination of your use of the Service for any reason, you remain responsible for any outstanding obligations you have incurred (e.g., pending transactions or fees). CoinsSend will have no further obligation to provide the Service to you. Any rights or licenses granted to you under these Terms will end. However, any rights and remedies of CoinsSend with respect to any breach by you of these Terms will survive the termination, as will the provisions of these Terms governing limitation of liability, indemnification, disclaimers of warranty, and any other provisions which by their nature are intended to survive.

11. Compliance and AML Measures

CoinsSend is committed to preventing misuse of its Service for illegal purposes. Although we do not require identity verification (KYC) for normal use of the platform, we maintain and enforce an Anti-Money Laundering (AML) Policy (available as a separate document) in line with industry best practices and legal requirements. By using CoinsSend, you agree that we may monitor transactions for signs of illicit activities and that we reserve the right to take appropriate action – such as blocking transactions, freezing funds, or requesting additional information – if we suspect your account or transactions are involved in money laundering, terrorism financing, fraud, or any other illegal activity. You also agree that we may cooperate with law enforcement authorities and share information regarding your usage or transactions in response to valid legal requests or as required by law. No Waiver: Our failure or delay in exercising any right, power, or privilege under these Terms shall not operate as a waiver thereof. Any waiver of any provision of these Terms will be effective only if in writing and signed by CoinsSend.

Severability: If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction or other authority, that provision will be enforced to the maximum extent permissible and the remaining provisions of these Terms will remain in full force and effect.

No Partnership: You and CoinsSend are independent parties. Nothing in these Terms shall be construed as creating any agency, partnership, joint venture, or other form of joint enterprise between us. You may not imply any relationship or affiliation between you and CoinsSend except as explicitly permitted by these Terms.

Assignment: You may not assign or transfer any rights or obligations under these Terms without our prior written consent. CoinsSend may assign or transfer these Terms or any rights or obligations hereunder at its discretion (for instance, in the event of a restructuring or project transfer to another operator). These Terms will bind and inure to the benefit of the parties, their successors, and permitted assigns.
